These Terms of Service govern your use of the Chroma Color Palette Maker app. Please read them carefully before using the App.

1. Acceptance of Terms

By downloading, installing, or using Chroma Color Palette Maker ("the App"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, do not use the App.
We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance.

Some features require creating an account. You agree to provide accurate, current information and keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
Notify us immediately at hello@chromaapp.com if you suspect unauthorized access to your account.

The App offers free access to certain features, including up to 24 AI palette generations.
Additional AI generations, premium palettes, and advanced export options may require an in-app purchase or subscription.
All purchases are processed through Apple's App Store and are subject to Apple's terms.
We do not offer refunds for in-app purchases except as required by applicable law or Apple's refund policy.

You retain ownership of any palettes, artwork, or content you create and submit to the community gallery ("User Content").
By submitting User Content, you grant Chroma a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your content within the App.
You represent that you have the right to submit any User Content and that it does not infringe any third-party rights.
You may delete your submitted content at any time from your profile.

You may not use the App to submit content that is unlawful, harmful, hateful, sexually explicit, or infringes intellectual property rights.
You may not reverse engineer, decompile, or attempt to extract source code from the App.
You may not use automated tools, bots, or scripts to access the App or generate palettes at scale.
You may not impersonate another person or use a false identity.
Violation of these rules may result in account suspension or termination.

AI-generated palettes are created using machine learning models. Results may vary and are not guaranteed to be unique.
You are responsible for how you use AI-generated content. Chroma makes no warranties about the suitability of AI output for any particular purpose.

The App, including its design, graphics, curated palettes, and code, is owned by Chroma and protected by applicable intellectual property laws.
You may not reproduce, distribute, or create derivative works from any part of the App without our express written permission.
The Chroma name and logo are trademarks of Chroma. You may not use them without permission.

The App is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
We are not responsible for any loss of data, palettes, or content.

To the maximum extent permitted by applicable law, Chroma shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.
You may delete your account at any time within app settings or by contacting us.
Upon termination, your right to use the App ceases immediately.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law.
